This is a translation of the Polish Regulamin, provided for information. In the event of any discrepancy, the Polish version prevails.
§ 1 General provisions
- These Terms are available at https://szukam-niani.pl/en/terms. They can be read and saved.
- These Terms set out the rules for using the Szukam Niani website and the Szukam Niani mobile app.
- The website is used to present the service and to download the app. No accounts, listings or payments are handled on the website. Accounts, listings, profiles, availability applications, contact and payments are available only in the mobile app.
- The service is provided by DOBRZYNSKI COMPANY Sp. z o.o., with its registered office in Toruń (87-100 Toruń), ul. Gdańska 4A, entered in the register of entrepreneurs of the National Court Register kept by the District Court in Toruń, 7th Commercial Division of the National Court Register, under KRS number 0000917814, NIP (tax ID) 8792733595, REGON 389750248, with share capital of PLN 6,000.00 (the "Administrator"). The Administrator runs the service under the IT Hero brand.
- Messages to the Administrator, including complaints, content reports and notices of withdrawal from the contract, should be sent to rodo@ithero.pl.
- The processing of personal data is described in the privacy policy (in Polish).
§ 2 Definitions
The terms used in these Terms mean:
- App - the Szukam Niani mobile app, available in the App Store and on Google Play.
- Website - the website https://szukam-niani.pl.
- User - an adult who has created an account in the App as a parent or as a nanny.
- Parent - a User who publishes a listing looking for a nanny for a child.
- Nanny - a User who maintains a profile and applies to selected listings by declaring availability.
- Listing - content published by a parent describing their childcare needs.
- Profile - information about a nanny visible to parents in the App.
- Free plan - the free-of-charge scope of the service, in which a parent may contact one selected nanny once per calendar month.
- Premium plan - a paid monthly subscription that removes the free plan contact limit and includes the Trusted Nannies module.
- Billing period - one month counted from the day the premium plan is purchased to the day before the same day of the following month. If there is no such day in a given month, the period ends on the last day of that month.
- Trusted Nannies module (Polish: Zaufane nianie) - a premium plan feature that shows a parent's listing only to nannies who have already worked through the App.
- Paddle - Paddle.com Market Limited, the entity handling payment for the premium plan. The parent concludes the purchase contract with Paddle.
- User Content - content posted in the App by a User, in particular a listing, a profile, an availability application and a reference.
§ 3 Provision of services
- The App connects parents looking for a nanny for their child with people who want to take up such work. The parent publishes a listing. The nanny declares availability for listings that suit her. The parent places the call - using the Call button in the App.
- The childcare contract is concluded directly between the parent and the nanny. The Administrator provides a tool for establishing contact and is not a party to that contract. The Administrator does not supervise the childcare and is not responsible for its performance.
- Visiting the Website allows you to learn about the service and download the App. It does not create an account.
- Using the App requires a device with an up-to-date iOS or Android system and Internet access. The User bears the cost of the Internet connection according to their operator's tariff.
- By creating an account in the App and accepting these Terms, the User concludes with the Administrator a free-of-charge contract for the provision of electronic services. The contract covers maintaining the account, publishing a listing or profile, declaring availability, notifications and contact within the free plan.
- The premium plan is activated once Paddle confirms successful payment. From that moment the parent uses the premium plan under § 6.
- Before choosing the premium plan, the parent is shown the gross price, the billing period, information about automatic subscription renewal and how to cancel.
- Using the Internet involves risks, including malware and phishing. The User should secure their device and not share access to their account.
§ 4 App account
- An account can be created only in the App. Creating an account requires accepting these Terms.
- A User must be an adult with full legal capacity. The App is not intended for children. Children's data is entered in a listing by the parent.
- The User provides truthful data and updates it when it changes. One person may have one account. An account may not be shared or used jointly with another person.
- A nanny's profile visible to parents shows the data the nanny provides, in particular first name, gender, date of birth and location. The phone number is not shown in the profile. It is used to connect calls via the Call button.
- A nanny who does not respond to a cooperation proposal within three days is no longer displayed in the list of active profiles. Hiding a profile does not delete the account or data.
- The account contract is concluded for an indefinite period. The User may delete the account in the App or send a deletion request to the address given in § 1. Deleting the account terminates the account contract.
§ 5 Listings, applications and references
- The parent publishes a listing describing their needs, location, schedule and rate, together with any information about the children they choose to provide.
- The nanny browses listings in her area and declares availability only for those that suit her.
- In the free plan, a parent may contact one selected nanny who has declared availability once per calendar month. An unused contact does not carry over to the next month. Nannies may declare availability regardless of the parent's plan.
- After the cooperation ends, the parent may give the nanny a reference or rating. A reference should be truthful and relate to the cooperation. It is visible in the nanny's profile to other parents.
- The Administrator may refuse to publish a reference or remove it if it is untrue, was written by the nanny herself or violates § 8.
§ 6 Monthly premium subscription and payments
- The premium plan is a monthly subscription and costs PLN 29 gross per billing period. The price includes VAT.
- In the premium plan, the parent may contact without limit the nannies who have declared availability for their listings, and may use the Trusted Nannies module.
- Payment is handled by Paddle. The parent concludes the purchase contract with Paddle on the terms presented at checkout before payment. The Administrator does not store the full payment card number.
- The fee for the first billing period is charged at purchase. The subscription renews automatically for subsequent billing periods, and the fee for each subsequent period is charged on the first day of that period to the payment method provided at purchase, until the parent cancels.
- If the fee for the next period cannot be collected, Paddle may retry the charge. Until the payment is received, the parent uses the free plan. After successful payment the premium plan is reactivated and a new billing period starts on the day of that payment.
- The parent may cancel the subscription at any time, in the manner indicated by Paddle at purchase or by message to the Administrator at the address in § 1. To avoid being charged for the next period, cancellation must be made no later than the last day of the current billing period.
- Cancellation stops further charges. Access to the premium plan continues until the end of the already paid billing period. After that, the parent uses the free plan. No refund is due for the unused part of a period, subject to sections 10-11 and to mandatory provisions of law.
- Deleting the account in the App ends the subscription at the end of the paid billing period and stops further charges.
- The Administrator notifies the parent of a change in the premium plan price in the App or by email at least 30 days before the start of the billing period from which the new price is to apply. A parent who does not accept the new price may cancel the subscription before that day. A price change does not apply to a period already paid for.
- A consumer may withdraw from the premium plan contract within 14 days of its conclusion without giving a reason. The notice is sent to the address in § 1. A model notice is provided at the end of these Terms. Automatic renewal of the subscription is not the conclusion of a new contract and does not open a new withdrawal period.
- If the consumer requests that the premium plan start before the end of the 14-day period and the service is fully performed before that period ends, the right of withdrawal expires. Where performance has started at the consumer's request and withdrawal occurs before full performance, the consumer bears a cost proportional to the period of use of the plan until withdrawal.
- The right of withdrawal described above is not available to persons who are neither consumers nor entrepreneurs with consumer rights.
§ 7 Termination
- The User may stop using the App at any time and delete the account under § 4.
- The Administrator may terminate the account contract for good cause, in particular in the event of a serious or repeated breach of these Terms. The Administrator informs the User of the termination, stating the reason, at the address linked to the account or the address from which the User corresponds.
- Termination of the account contract does not release the User from the obligation to pay for an already started, paid premium plan period or from settling services performed before termination.
§ 8 Rules of use and prohibited content
- It is prohibited to:
- provide unlawful content,
- incite violence or hatred,
- infringe the rights of others, including personal rights, image rights and copyright,
- publish false or misleading content,
- publish erotic or pornographic content or sexual propositions,
- publish advertising, spam and links promoting third-party services,
- include contact details in the text of a listing or profile outside the fields intended for them,
- disrupt the operation of the App or the Website,
- create more than one account or share an account with another person,
- use the App to build a contact database or for purposes other than looking for childcare or for work as a nanny.
- The User is responsible for their content. The Administrator may review it for compliance with the law and these Terms.
§ 9 Reports and actions of the Administrator
- Anyone may report content they consider unlawful or contrary to these Terms. The report is sent to the address in § 1. It should state which content it concerns, where it is in the App and why it is considered prohibited, together with the reporter's name and email address so that a reply can be sent.
- Upon becoming aware of unlawful content or content contrary to these Terms, the Administrator may remove the content, hide the listing or profile, restrict account features, suspend the account or delete it.
- The Administrator informs the User whose content or account is affected of the decision and its reasons, if it has contact details. Within 14 days of being informed of the decision, the User may send an appeal to the address in § 1. The Administrator handles the appeal within 14 days and informs the User of the outcome.
- The Administrator is not liable for User Content if it is not aware of it and, upon becoming aware, promptly removes the content or blocks access to it.
- In the case of frequent, manifestly unfounded reports or frequent publication of manifestly prohibited content, the Administrator may temporarily restrict the ability to report or publish.
§ 10 Complaints
- A complaint about the operation of the App or the premium plan may be submitted to the address in § 1. The complaint should include the name, the email address linked to the account, a description of the issue and the expected resolution.
- The Administrator handles the complaint within 14 days of receipt and replies to the complainant's email address.
- Complaints do not cover the childcare contract between the parent and the nanny. The Administrator does not perform that contract.
§ 11 Personal data and content rights
- Personal data is processed in accordance with the privacy policy (in Polish).
- Rights to the App, the Website, the Szukam Niani name and the Administrator's marks belong to the Administrator. The User receives the right to use them to the extent necessary to use the service.
- The User retains the rights to their content. By publishing it in the App, the User grants the Administrator a non-exclusive licence to store and display that content to other Users within the operation of the service, for the duration of its publication and for the time needed to handle reports and pursue claims.
§ 12 Changes to the Terms
- The current version of these Terms is published at the address given in § 1.
- The Administrator may change these Terms for important reasons: changes in the law, changes to App features, changes to payment methods or the need to correct an error or ambiguity.
- The Administrator informs Users of any change affecting their rights or obligations in the App or by email, if it has their address. A User who does not accept the change may delete their account before the change takes effect.
- A change does not remove rights already acquired. Until the end of a paid premium plan period, the price and scope of the plan in force at the time of payment for that period apply.
§ 13 Final provisions
- These Terms are governed by Polish law.
- These Terms do not limit consumer rights under provisions that cannot be excluded by contract. In the event of a conflict, those provisions apply.
- Disputes are resolved by the court having jurisdiction under the law. A consumer may also use out-of-court dispute resolution, including the assistance of the competent consumer ombudsman or the permanent consumer arbitration court at the competent voivodeship inspector of the Trade Inspection.
